Lightwave PLUS Terms and Conditions

These Lightwave PLUS Terms & Conditions are between you and Lightwave PLUS Limited and their affiliates ("Lightwave", “we”, "us" or “our”) and they govern your and our respective rights and obligations.
Together with the below linked terms and notices (collectively, these "Terms"), they constitute the agreement between you and us related to your Lightwave PLUS membership on the website (the "Lightwave Website"). Please read these Terms carefully.

1. The Service
Lightwave PLUS is a membership program offering multiple benefits and services to its members as set out in these Terms (collectively “PLUS Service”).
Lightwave PLUS Limited collects the Lightwave PLUS membership fee and is the seller of record of all services constituted in the PLUS service. LightwaveRF Technology Limited is the seller of record of all products purchased by you under the Lightwave PLUS Service.
If you sign up for a Lightwave PLUS membership directly through us, you expressly request that we start providing you the PLUS Service within your 14-day cancellation period.

2. Lightwave PLUS Benefits
Lightwave PLUS members can benefit from the PLUS Service, which comprise a range of benefits described HERE.

3. Membership
a. Membership fees, models and duration
The current membership fees, the available membership models and duration of the Lightwave PLUS Service are stated HERE. When you sign up for your Lightwave PLUS membership you will find details about the membership model you are subscribed to, the applicable membership fee and the next due date in Your Account.
The Lightwave PLUS membership fee is non-refundable except as expressly set forth in these Terms.
b. Payment
If you sign up for your Lightwave PLUS membership and you do not notify us before the next due date of your membership fee that you want to end your membership at this date or cancel your membership in your PLUS customer account, we will automatically charge the then-applicable periodic membership fee using your preferred payment method.
If your preferred payment method becomes invalid during your membership period, or if the charge is refused for any other reason outside our control, you authorise us to use any other payment method we have on file in your Lightwave PLUS customer account. If all your payment methods on file are declined, you must provide us a new eligible payment method within 30 days or your membership will be cancelled.
c. Cancellation by you and refunds
You may cancel your Lightwave PLUS membership at any time by contacting Lightwave customer services. You may stop auto-renewal of your subscription and your subscription will no longer renew automatically at the end of your billing cycle. For example, if you purchase an annual subscription, you may stop the auto-renewal at any time during the subscription, and the subscription will stop as of the end of the current annual billing cycle. You will continue to receive the Lightwave PLUS service until your billing cycle ends, but you can choose to turn off specific Lightwave PLUS features in the app settings at any time. You will not receive a refund even if you stop using the service or turn off Lightwave PLUS features during your final billing cycle.
Lightwave PLUS memberships redeemed through a promotional or gift code are not refundable.
d. 14-day right of withdrawal
If you paid your membership fee to us as soon as you joined Lightwave PLUS, you may withdraw within 14 days. If neither you nor anyone authorised by you to use your account has taken advantage of any Lightwave PLUS benefits in the current membership period, we will refund this membership fee in full. Otherwise, we will issue you a partial refund based on use of Lightwave PLUS benefits during that time by you or anyone authorised by you to use your account. After the first 14 days you will not be eligible for a refund (or any alternative remedy), unless the service is defective as stated below. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
e. Promotions and trial memberships
From time to time, we may offer certain customers specific trial or other promotional memberships, which are subject to these Terms except as otherwise stated in the promotional membership terms. Trial and promotional members may at any time choose not to convert or continue to paid or non-promotional membership as set out in these Terms and in the promotional membership terms through Your Account.
f. Acceptance of membership
We reserve the right to accept or refuse your membership, to the extent permitted by applicable law.
g. No transfer or assignment of membership or benefits
You may not transfer or assign your Lightwave PLUS membership or any PLUS benefits including promotion codes for Lightwave PLUS memberships or benefits, except as expressly allowed in these Terms.
h. No resale, rental or shipping to customers
Lightwave PLUS members are not permitted to purchase products for the purpose of resale, rental, or to ship to their customers or potential customers using PLUS benefits.
i. No minors
The Lightwave PLUS Service is only available to end consumers aged 18 years or older.

4. Protection of Your Data
Your personal data (“Data”) which is processed by Lightwave PLUS Limited and/or Lightwaverf Technology Limited may include:
- Data supplied by you
- Data collected when you are supplied with PLUS services
- Data collected when you are otherwise in contact with Lightwave PLUS Limited or Lightwaverf Technology Limited.
You consent to your Data being supplied to any entity which is a parent or subsidiary or subsidiary of a parent of Lightwave PLUS Limited (a “Lightwave Group Company”).
The purposes for which Data may be processed by Lightwave PLUS Limited or any other Lightwave Group Company include:
- Providing PLUS Services
- Making changes to PLUS Services and developing new PLUS Services
- Accounting and audit, safety and security, fraud prevention and investigation, and systems testing, development and maintenance
- The management and administration of Lightwave PLUS customer relations, service recovery and assisting Lightwave PLUS Limited in future dealings with you
- Credit checking and scoring where permitted
- Customer profiling and other marketing and market research analysis
- Communicating to you information about Lightwave PLUS, including any information about Lightwave PLUS benefits, using any contact details provided
- Communicating to you about other products or services offered by Lightwave PLUS Limited or other Lightwave Group companies or other carefully selected companies, using any contact details provided
- Conducting market research
- Any other purpose which is obvious or communicated to you.
Consent to receive marketing and market research communications is requested at the time of enrolment and may also be given by you subsequently. Where consent is given it may be withdrawn by you by writing to Lightwave PLUS Limited or by any other means for withdrawing consent that may be made available by us.
Our Privacy Policy shall also apply. In the event of a contradiction between the terms of the Privacy Policy and these Terms, these Terms shall prevail.

5. Termination
We may terminate your Lightwave PLUS membership with 14 days’ notice for convenience and will issue a prorated refund of your paid Lightwave PLUS membership fee based on the time remaining in your current membership period.
We may terminate your Lightwave PLUS membership immediately by notice if we consider that (a) your use of the PLUS Service materially breaches these Terms or any applicable law or (b) you fraudulently use or misuse the PLUS Service. In this case we will not give any refund. We will inform you of the termination of your Lightwave PLUS membership and your right to appeal.
You may terminate your Lightwave PLUS membership at any time in accordance with Clause 3.c.

6. Agreement Changes
We may change these Terms or the PLUS Service, or any part of it, at any time: for legal or regulatory reasons; for security reasons; to enhance existing features or add additional features to the PLUS Service; to reflect advancements in technology; to make reasonable technical adjustments to the PLUS Service; and to ensure the ongoing operability of the PLUS Service.
If we make changes, we will inform you in due form and time about it and remind you of your rights. You will be able not to accept these changes and you will keep the possibility to cancel your Lightwave PLUS membership at any time.
Regardless of any changes to these Terms or the PLUS Service, any increase in the applicable membership fee will not apply before the end of your current membership period.
If any change is found invalid or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions

7. Our Liability
We are liable for any damage you suffer as a result of gross negligence or wilful misconduct by us, including by our directors and legal representatives.
In addition, we are liable for breach of our obligations under these Terms which are essential for the provision of Lightwave PLUS and which you rely on when joining Lightwave PLUS. In this case, we are only liable for losses and damage that were foreseeable to both you and us when you joined Lightwave PLUS.
Nothing in this paragraph affects your statutory rights as a consumer or limits our liability for damages from injury to life, body or health, for a breach of a guarantee or for fraudulently concealed defects.

8. Events Beyond our Reasonable Control
We will not be held responsible for any delay or failure to comply with our obligations under these Terms if the delay or failure arises from any cause which is non foreseeable and beyond our reasonable control.

9. Applicable Laws
These Terms shall be governed by and construed in accordance with English law and you submit to the non-exclusive jurisdiction of the English courts to resolve any disputes that may arise out of them.
Any provision of these Terms declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions remaining which shall continue unaffected.
